Yes, it is Legal to Dumpster Dive in California.
It is allowed to look through trash because of a Supreme Court decision in California v. Greenwood (1988).
There are a few things that can make it illegal:
- Trespassing: Diving in dumpsters located on private property like behind fenced enclosures is illegal.
- Local ordinances: Cities and counties can have specific laws regarding dumpster diving. For instance, San Francisco prohibits it in all public areas.
- Disorderly conduct: Creating a nuisance or blocking access can invite police intervention.
So, even though the things that have been thrown away are considered abandoned, where they are and any local laws become very important.
